Conditions of entry and privacy policy for the competition "Think! Win Shoes"

1. Promoter

The "Think! Win Shoes" competition is organised by legero united digital GmbH, Legero-United-Strasse 4, 8073 Graz (hereinafter referred to as "we"). Participation in the competition is free of charge but, in exchange for your participation in the competition, you agree to receive our newsletter in the future at the email address you provide (exchange: competition participation for consent). Your consent to receive the newsletter is required for participation in the competition. Participation without granting this consent is not possible but you can unsubscribe from the newsletter at any time, whereupon you will no longer receive our newsletter. You can find more information about the processing of your data and your option to unsubscribe from the newsletter below. By entering the competition and (to the extent applicable) claiming a prize, you accept these Conditions of Entry and acknowledge the information on data processing set out below. Participation in the competition without agreeing to these terms and conditions is not possible.

2. Participation in the competition

a) Registration period

The registration period runs for an indefinite period of time. For the next draw, registrations prior to 30/06/2025, 23:59 will be used. For successful registration, name and e-mail address must be provided during the registration phase. To complete the participation, the conditions of participation must be accepted and the privacy policy must be acknowledged. You will then receive an e-mail at specified e-mail address containing a confirmation link – you must click on the confirmation link to be entered in the competition.

b) Participant selection/winner selection

After the end of the registration period, the winners will be selected within four weeks from all participants who have validly registered for the competition in accordance with these conditions of participation. The selection is subject to a random principle and takes place in camera and without recourse to legal action.

c) Competition procedure & prize

The selected winners will be notified via the email address provided. Winner of the "Think! Win Shoes" competition choose an available shoe on thinkshoes.com. In certain circumstances, a model request may not be able to be accommodated due to non-availability. The pair of Think! shoes won will be sent by legero united digital GmbH to the address provided during registration or in the course of the prize announcement (shipping only within the EU). Winning vouchers will be sent by e-mail.

2.2. Announcement of win and shipment

All selected winners will be notified after selection via the email address provided during the competition registration. The winners notified in this way must respond to this notification within one week and declare that they accept the prize. If the prize notification cannot be sent for reasons relating to the participant or the details provided by the participant (provision of an incorrect e-mail address, etc.) or if the winner does not declare his or her acceptance of the prize within one week of receipt of the prize notification, the award will lapse and a new winner will be selected in his or her place from the remaining participants. The same applies if the prize cannot be sent within two weeks from the date of dispatch for reasons relating to the participant or the details provided by the participant (provision of an incorrect postal address, etc.). In such cases, these Conditions of Entry shall continue to apply. legero united digital GmbH is not liable for late receipt of the prize by the participant or for loss of the prize in shipment. The right to participate is not transferable. Cash payment or exchange of the prize is not possible. Participants are responsible for the accuracy of the contact information provided.

2.3. Eligibility

Participants must be at least 18 years old and have legal capacity at the time of participation. Minors who nevertheless participate cannot be selected as winners. Employees of Legero Schuhfabrik GesmbH and its subsidiaries as well as all persons involved in the conception and implementation of the "Think! Win Shoes" are excluded from participation. Direct and indirect relatives and cohabiting partners are also excluded. Participation is only possible online via www.thinkshoes.com/en/win-shoes/. Participation is free of charge except for transmission costs that may be incurred according to the tariff chosen by the participant's mobile phone or Internet provider. Only one entry per person and competition is allowed. legero united digital GmbH is entitled to exclude individual persons from participation if there are justified reasons, such as violation of the conditions of participation, (attempted) manipulation, etc., and reserves the right to take legal action. If the conditions for exclusion are met, winnings may also be subsequently disallowed or reclaimed. Recourse or any claims by participants against legero united digital GmbH arising for exclusion are excluded. Participation via a service provider, particularly a competition entry service / competition service, is not permitted. The same also applies to competition clubs, automated participation via competition robots, intentionally providing false information, and participation with a so-called "throwaway email address".

3. Cancellation of competition

legero united digital GmbH reserves the right to cancel the competition for important reasons. Cancellation for good cause may occur in particular if proper execution of the competition can no longer be guaranteed for technical or legal reasons.

4. Data processing

When you enter the "Think! Win Shoes" competition, we will process your personal data to the extent described below. The personal data you provide when participating in the competition will be treated with absolute confidentiality and will only be used to process the competition and for your associated registration for our newsletter.

4.1 Purpose and legal basis of data processing

If you enter this competition, we will process your personal data in order to conduct the competition. Personal data will be processed for this purpose in order to select winners, notify them and send them prizes, as well as to ensure that each participant takes part in the competition only once. The data processing is carried out in accordance with Art 6 para 1 lit b of the DSGVO on the basis that it is necessary to be able to conduct the competition. The sending of the newsletter to you, which you agree to by entering this competition, is based on this consent of yours (Art 6 para 1 lit a DSGVO; § 174 para 3 of the Austrian Telecommunications Act (TKG)). Since participation in the competition is only possible if you give this consent (exchange: participation for consent), this consent is necessary for the data processing and does not violate the prohibition on coupling covered by Art 7 para 4 DSGVO. However, you can revoke this consent at any time by unsubscribing from the newsletter. Such cancellation will not affect your participation in the competition. You can find more information about this below. For these purposes, only the data that you provided when registering for the competition will be processed. When registering for the competition, data mandatory for participation is indicated, the provision of all other data is voluntary and not required for participation.

4.2 Data transfer to third parties

We will only pass on your data to third parties for the above-mentioned purposes and in any case only if this is necessary for the implementation of the competition or your registration for our newsletter and the dispatch of the newsletter to you. If you win, we pass on your address data to a transport and logistics company, for example, insofar as this is necessary to send your prize. In addition, to ensure the security and efficiency of our working environment, we use IT and marketing service providers as processors for the purpose of sending marketing material and our newsletter. Your personal data may also be made accessible to them. In addition, we will only disclose your personal data to legal representatives, authorities and courts if this is necessary to enforce or defend against any (threatened/potential) legal claims or if we are legally obliged to do so or are instructed to do so by court order or administrative decision. We do not transfer personal data to third countries outside the European Economic Area without first obtaining your consent (which you can withdraw at any time).

4.3 Retention of personal data

Your personal data will be retained by us only for as long as reasonably considered necessary by us to achieve the purposes set out above and as permitted by applicable law. This means that we keep e-mails and messages that we receive or send in connection with the competition as business letters for seven years (legal obligation to keep records pursuant to Section 212 of the Austrian Commercial Code). In the course of your registration for our newsletter, we process your contact data in our newsletter database for sending our newsletter to you until you revoke your consent to receive the newsletter (i.e. unsubscribe) or until we stop sending such newsletters. Your other data that we process in connection with your participation in the competition will be deleted after the end of the competition. We will retain your data longer than the aforementioned deletion period if and as long as we need it to enforce or defend specific legal claims.

5. Newsletter

If you participate in a competition of the brand Think! we will inform you regularly about our products and offers of our brands superfit, legero and Think! You can unsubscribe from the newsletter at any time, information for doing so can be found in the newsletter itself. However, you may also contact us at the contact address below to decline to receive any further mailings. Unsubscribing from the newsletter does not exclude you from participating in the competition.

6. Consent to the conditions of entry

By participating in this competition, the participant expressly accepts these conditions of participation and acknowledges the processing of his/her personal data as presented. This consent can be revoked at any time in writing to legero united digital GmbH, Legero-United-Strasse 4, 8073 Feldkirchen bei Graz, Austria or by sending an e-mail to help_worldwide@thinkshoes.com in which case further participation in the competition will no longer be possible.

8. Final provisions

The competition is subject to Austrian law. Irrespective of this, you also enjoy the protection of all mandatory protection provisions (i.e. in particular consumer protection law) of the legal system that would be applicable without this choice of law (in particular the legal system of the country to which the competition is directed if you have your domicile or habitual residence in this country).
